Avista Care & Avista Chat – Terms of Service

Welcome to Avista Care and Avista Chat. By using any part of these services (the “Service”), you agree to the Terms of Service (“Terms”) outlined here. If you do not agree, please discontinue use of the Service.
1. Definitions
- “Avista Care” refers to Avista’s website maintenance, monitoring, security, performance, and support services.
- “Avista Chat” is a sub-service of Avista Care that allows customers to create, manage, and embed AI chatbots or conversational assistants on their websites or platforms.
- “Customer” means the person or organization using the Service.
- “Website(s)” means the sites you manage or connect through Avista Care or Avista Chat.
- “Account” means your Avista login and dashboard access.
2. Service Description
Avista Care
Avista Care provides ongoing maintenance, updates, monitoring, security scanning, backups, performance improvements, and technical support for your WordPress or supported websites.
Avista Chat
Avista Chat allows you to:
- manage a custom AI chatbots,
- upload content or documents for training,
- embed the chatbot on your site,
- monitor interactions, and
- manage conversations through a unified dashboard.
Avista Chat operates under Avista Care’s infrastructure and policies.
3. Your Responsibilities
By using the Service, you agree to:
- Provide accurate information about your Websites and content.
- Ensure you have the rights to publish any data, documents, or text used to train Avista Chat.
- Not use the Service for illegal, harmful, or unauthorized purposes.
- Not overload, misuse, or attempt to bypass security systems.
- Keep your Account credentials secure.
- Comply with all applicable laws regarding data, privacy, and content.
You are fully responsible for all activity under your Account.
4. AI Content & Limitations (Avista Chat Specific)
- Avista Chat generates responses using AI. Responses may be incorrect, incomplete, or unexpected.
- You are responsible for reviewing and moderating how your chatbot interacts with users.
- Avista is not responsible for decisions you make based on AI-generated content.
- You may not use Avista Chat to create or distribute harmful, misleading, or illegal content.
5. Data & Content Rights
- You retain ownership of the content you upload (documents, text, website data, prompts, etc.).
- Avista may process your data only for the purpose of delivering the Service (e.g., training, indexing, monitoring, improving performance).
- Avista does not claim ownership over your Websites or AI training materials.

6. Fees & Billing
- Pricing is based on your selected plan for Avista Care and/or Avista Chat.
- Fees are non-refundable unless explicitly stated.
- Failure to maintain valid payment information may result in suspension or termination.
- Taxes or duties related to your use of the Service are your responsibility.
7. Termination & Cancellation
You may cancel your subscription at any time. Avista may also terminate access if:
- you violate these Terms,
- payment fails repeatedly,
- or the Service is discontinued.
Upon termination:
- Dashboard access ends,
- Avista may delete stored data, backups, and chatbot information after a reasonable period,
- Embeds or API-based chatbots will stop functioning.
8. Intellectual Property
- All software, infrastructure, dashboards, design, models, and technology used for Avista Care and Avista Chat remain the property of Avista.
- You may not reverse engineer, modify, or replicate the underlying systems.
- You retain full ownership of your site content and uploaded training data.
9. “As-Is” Service & Limitations of Liability
The Service is provided as is and as available. Avista does not guarantee:
- uninterrupted uptime,
- error-free performance,
- perfect security, or
- guaranteed AI accuracy.
Avista is not liable for:
- indirect or consequential damages,
- loss of business, data, or revenue,
- issues caused by third-party plugins, hosts, APIs, or integrations.
Avista’s total liability will not exceed the amount you paid in the previous 12 months.
10. Modifications to the Service or Terms
Avista may update features, pricing, or these Terms at any time.
Material changes will be communicated in advance (e.g., via email).
Continued use of the Service means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of Iceland unless otherwise required by EU/EEA regulation.
